1. GENERAL PROVISIONSThese General Terms and Conditions of Sale (hereinafter “Terms and Conditions”) are established between the Client and Tahiti Wifi (hereinafter “Tahiti Wifi”), a limited liability company with a capital of 1,000,000 XPF, registered under Tahiti Number C76367, TPI 18110 B, with its registered office on the 2nd floor of the Manarava Building in Faaa, Auae, RDO, BP 335 – 98713 Papeete. The terms and conditions set forth herein apply to all services provided by TAHITI WIFI in connection with the rental of mobile routers and the sale of SIM cards and imply the Client’s unconditional acceptance of these conditions. The general conditions applicable to the relationship between the Client and Tahiti Wifi are those in effect at the time of the Client’s reservation, namely the general conditions as displayed on Tahiti Wifi’s website at the time of the order (http://www.tahitiwifi.com).

2. DESCRIPTION OF SERVICES COVERED BY THESE TERMS

2.1 MOBILE HOTSPOT RENTAL
Tahiti Wifi rents routers with mobile Wi-Fi access that allow mobile Internet use in French Polynesia and around the world (120 destinations), without incurring data roaming charges. Reservations can be made on the website http://www.tahitiwifi.com through the reservation platform or at the airport agency (Tahiti Faa’a). Rental is subject to payment for the services and after obtaining an automatic authorization from your bank for a security deposit, as established in Article 4.1 below, of 20,000 XPF (twenty thousand Pacific francs), which is equivalent to 167.64 euros. This security deposit can also be made by check or cash. In the event of loss or damage to the device, the said amount will be deducted within 7 (seven) days following the end of the rental contract. For more information regarding “damaged or lost devices,” please refer to Section 4 of these general terms and conditions.

2.2 SALE OF SIM CARDS
Tahiti Wifi sells SIM cards covering French Polynesia or certain international destinations (U.S.A, France, New Zealand, etc.). Reservations can be made on the website http://www.tahitiwifi.com through the reservation platform or at the airport agency (Tahiti Faa’a). The sale is subject to payment for the selected SIM card. The card purchased by the Client belongs to them, and no security deposit is required.

2.3 TAHITI WIFI SERVICE USAGE RECORD
The Client must fill out a secure online form available on the website to make an online reservation. The Client must also provide this information for a reservation at the airport agency. The requested personal information includes:

  • Arrival and departure dates
  • First and last name
  • Country and city of residence
  • Email address
  • Phone number (for Polynesian residents)
  • Airline, arrival time, and departure time

2.4 TAHITI WIFI COMMITMENTS
Tahiti Wifi is committed to a best-effort obligation to provide the Client with the services offered and reserved throughout the entire contractual relationship, which commences upon validation of the online reservation form or at the airport agency by the Client. Therefore, Tahiti Wifi remains subject to the availability conditions of the mobile phone network as established by local operators under a license to operate under the Telecommunications Code of French Polynesia, and specifically, the partner operators of Tahiti Wifi, as well as the state of technological developments of the network in different islands of French Polynesia as implemented by these operators. Tahiti Wifi cannot be held responsible for network unavailability periods, unless there is an established breach of its own obligations or temporary suspensions due to partner operators.
Tahiti Wifi is also subject to the availability conditions of international mobile operators for its international box and international SIM card offering, as well as the state of technological developments of the network in different countries. Tahiti Wifi cannot be held responsible for network unavailability periods of international operators or temporary suspensions due to international operators, unless it is reasonably possible for Tahiti Wifi to inform the Client of such suspensions and is pre-informed by partner operators.
The network coverage map in French Polynesia is available on Tahiti Wifi’s website. The list of covered countries internationally is also provided on the site. The airport agency also has the aforementioned elements available to the Client. Since network coverage in French Polynesia varies by island, this map is also sent to the Client in the automatic reservation email for full transparency.
Furthermore, Tahiti Wifi cannot be held responsible in any case when network access is interrupted due to special use conditions by the Client (e.g., remote use on the lagoon, in the air, or in the mountains, remote islands with poor network, mountainous or desert regions, etc.).
Tahiti Wifi commits to delivering the equipment in good working condition and ensuring that it continues to function properly during the rental period. The equipment is covered by a warranty provided by Tahiti Wifi for the entire rental period.
The warranty offered by Tahiti Wifi involves the complete replacement of the equipment (device) in the event of malfunction not caused by damage by the Client. Replacement will be carried out by Tahiti Wifi as soon as possible, considering the Client’s geographical location during their stay in French Polynesia and will not exceed 1 (one) week in any case. The replacement of the equipment will be with an identical device or, where appropriate, due to technological evolution and mutability, a reasonably similar device for the remainder of the rental period.
The Client must immediately inform Tahiti Wifi upon detecting equipment malfunction or any usage issues. In such cases, Tahiti Wifi cannot be held responsible for the said malfunction.
Regarding the rental of an international box or the purchase of a SIM card, Tahiti Wifi commits under the same conditions, with the exception of equipment replacement in the event of proven malfunction (sending by mail internationally is not possible due to the short rental durations, the Client’s international travel not allowing a fixed address, and mailing times by postal companies). The Client is also required to inform Tahiti Wifi immediately upon detecting equipment malfunction or any usage issues. In such cases, Tahiti Wifi cannot be held responsible for the said malfunction.
Regarding the purchase of a SIM card, Tahiti Wifi cannot be held responsible in the event of malfunction due to the Client’s phone being incompatible. The Client is responsible for verifying that their phone is capable of using the offer. Tahiti Wifi’s staff is available to help the Client check this before making any purchase.

2.5 CLIENT COMMITMENTS

2.5.1 The Client agrees to:
a) Use the equipment and services provided by Tahiti Wifi in accordance with the applicable law in French Polynesia and ensure the proper functioning of the provided equipment.
If it is determined that the malfunction is due to the Client’s actions, the Client will be liable for a fixed penalty of 20,000 XPF (equivalent to the security deposit) for the damage suffered by Tahiti Wifi.
b) Not cause a decrease or damage to the network accessed through the equipment.

2.5.2 The Client accepts the rental conditions outlined in these General Terms and Conditions. Unless otherwise specified, the following elements apply:

  • The equipment will be delivered in accordance with Section 4 of these terms. Upon delivery, the Client must promptly inspect and test the equipment. The Client must immediately inform Tahiti Wifi of any non-conformity detected during this inspection or during subsequent use. In accordance with 2.5.1 a), any damage to the equipment found upon the return of the device will be the responsibility of the Client.
  • The Client assumes all responsibilities as the custodian of the equipment within the meaning of Article 1384-1 of the Civil Code; The Client agrees not to hold Tahiti Wifi responsible for (a) any costs, fees, charges, taxes, levies, taxes, or contributions resulting from the possession or use of the equipment, and (b) information resold by third parties, including public authorities, in connection with the use, operation, or maintenance of the equipment by the Client, except in cases where such elements are recognized as being at the initiative or at the express request of Tahiti Wifi. The Client must reasonably protect the equipment against the risks of destruction, damage, loss by fire, theft, burglary, electricity or water, as well as any natural elements (including but not limited to: sand, heat), and, in any case, comply with the usage conditions prescribed by Tahiti Wifi; The Client must keep the equipment in a clean and functional condition, in compliance with usage rules and the behavior expected of any custodian within the meaning of Article 1384-1 of the Civil Code. Risks related to wear and tear as well as any damage caused by a force majeure event or acts of a third party that are not attributable to the Client will be the responsibility of Tahiti Wifi, which will replace the equipment due to these circumstances.

2.5.3 In the event of the Client’s breach of their obligations under these General Terms and Conditions, Tahiti Wifi will suspend the Client’s use of the services as soon as the breach is noted by any means. Tahiti Wifi may inform the Client of the service suspension in advance within a reasonable period not exceeding 24 hours prior to suspension unless the breach may pose risks to the Tahiti Wifi network or infrastructure or is likely to cause harm to Tahiti Wifi’s reputation or management. During any suspension period, the Client will continue to pay all fees due under this contract for the suspended services. This is without prejudice to any additional charges related, if any, to damage to the equipment, as well as any collection or procedural fees related to the Client’s remedy of the breach.

3. BEGINNING, DURATION, AND TERMINATION OF THE CONTRACT
The service contract between Tahiti Wifi and the Client takes effect upon validation of the reservation form on the website http://www.tahitiwifi.com or when booking at the airport agency. Upon receipt of the reservation by Tahiti Wifi, the Client receives confirmation of their request. They become liable for the specified daily rental fees and corresponding to the required duration, as well as the conditions established from the date of delivery of the equipment until the date of its return. The contract ends as soon as the Client returns the equipment to Tahiti Wifi.

4. USAGE TERMS

4.1 FINANCIAL TERMS

  • Tahiti Wifi provides all fees related to equipment rental, including VAT, unless stated otherwise.
  • Tahiti Wifi requires a credit card guarantee from the Client at the time of reservation. In the case of using this security deposit, Tahiti Wifi will request authorization from the credit card issuer for an amount equivalent to the fees and amounts described in Section 4.2. Tahiti Wifi is entitled to use the credit card information to bill the Client for the use, replacement, or repair of the equipment.

4.2 CONNECTION OFFERING AND TAHITI WIFI DAILY QUOTA

4.2.1 DATA PACK OFFER (FRENCH POLYNESIA)
The daily quotas as established in the Contract and available for reference on the Tahiti Wifi website under the “Data Pack” offer are pooled and can be used whenever the Client wishes during their rental period.
Example: If a Client rents a device for 5 days with a 2GB quota, they have a available quota of 2GB, which they can use as they wish during these five days. If the Client exceeds the limit corresponding to their subscription plan, their access to the internet will be blocked. They are then required to contact Tahiti Wifi to renew their subscription by:

  • Phone at +689 89 78 03 33
  • Email at [email protected]
  • The direct data add-on link provided in the reservation email.

4.2.2 UNLIMITED DATA OFFER (FRENCH POLYNESIA)
High-speed daily quotas as established in the Contract and available for reference on the Tahiti Wifi website under the unlimited offer are subject to “fair use.” “Fair use” is a threshold that determines the limit of fair usage of the available bandwidth to which the router connects. This corresponds to a value of data volume exchanged, beyond which internet access is reduced compared to the maximum available speed but will not fall below 512 Kbits/s (for areas covered by 4G/3G). Tahiti Wifi provides unlimited internet access. However, beyond a certain data exchange volume, the connection is reduced. Our offers allow the use of the “fair use” envelope under the following conditions:

  • Comfort Offer: 1GB/day at high speed (then reduced speed)
  • Infinite Offer: 8GB/day at high speed (then reduced speed)
  • The high-speed quota extends over 24 hours and resets at 00:00.

4.2.3 UNLIMITED DATA OFFER (INTERNATIONAL)
High-speed daily quotas as established in the Contract and available for reference on the Tahiti Wifi website under the international unlimited offer are subject to “fair use.” “Fair use” is a threshold that determines the limit of fair usage of the available bandwidth to which the router connects.

  • World Starter Offer: 500MB/day at high speed (then reduced speed)
  • World Comfort Offer: 1GB/day at high speed (then reduced speed)
  • World Premium Offer: 2GB/day at high speed (then reduced speed)
  • Travel Offer (France, New Zealand, and Japan): 8GB/day at high speed (then reduced speed)

4.3 TAHITI WIFI USAGE MONITORING
Under a data pack offer (French Polynesia), the Client is responsible for monitoring their consumption, which can be checked at the following link: http://192.168.43.1/ or by phone at +689 89 780 333 or by email at [email protected].
For unlimited offers (French Polynesia or international), consumption monitoring is not necessary, but the daily consumed quota remains available:

  • For basic and starter offers, at the following link: http://192.168.43.1/
  • For comfort and premium offers (screen device), on the device’s home screen.

Consumption monitoring related to SIM cards is specific to the use of each SIM card from our partner operators and is indicated with the details of the purchased SIM card. Tahiti Wifi is unable to provide this information.

4.4 CHARGES FOR LOSS AND DAMAGE
As per the aforementioned provisions, the Client is solely responsible for any loss or damage to the equipment during the rental period. In the case of loss or damage (including inability to turn on, or broken device), the security deposit of 20,000 XPF (twenty thousand Pacific francs), equivalent to 167.64 euros, mentioned in Article 2.1 and paid at the time of reservation, will be retained.
The following fees will be applied in the case of loss, if Tahiti Wifi can differentiate, individualize, or deconstruct the nature of the damages:

  • Complete loss: 20,000 XPF (167 EUR)
  • Wi-Fi device: 20,000 XPF (167 EUR)
  • Charger: 1,200 XPF (10 EUR)
  • Cable: 1,200 XPF (10 EUR)

The previous paragraph does not apply, except due to the Client’s fault, if the Client has subscribed to the “Damage Insurance” option offered by Tahiti Wifi at a cost of 1,200 XPF at the time of reservation. It should be noted that the insurance covers the Client and applies only in cases of damage to the equipment returned.

4.5 DELAY
In the event that the Client is unable to return the equipment on time (including all accessories) to Tahiti Wifi, they will be charged a penalty of 5,000 XPF (five thousand Pacific francs) per day of delay until the equipment is effectively returned to Tahiti Wifi.
If, for any reason, the Client is unable to return the equipment, especially in cases of loss or theft, the Client will be liable for the amount corresponding to the complete loss of the equipment and should immediately contact Tahiti Wifi by email at [email protected] or by phone at +689 89 780 333 so that additional late fees are not incurred. Only the standard fees from the end of the contract date until the report of loss or theft will be charged.

5. DELIVERY
The Client is responsible for ensuring that the chosen delivery method is compatible with the order date and the first day of rental. If the delivery method chosen by the Client during the reservation phase is incorrect, it is the Client’s responsibility to notify Tahiti Wifi, which cannot be held responsible for delivery delays.

6.RETURN
All returns must be made by the end date of the rental corresponding to the duration of the ordered services and no later than the Client’s departure from Tahiti at Tahiti Faa’a Airport (or at the hotel if this option was chosen during the reservation). If the deposit is made at a hotel when it was initially intended for an airport agency, the Client will be charged an additional 3,000 XPF (three thousand Pacific francs), which is 25 EUR, due to the necessary courier service to retrieve the equipment. The Tahiti Wifi equipment must be returned in good working condition. If the Client leaves French Polynesia without returning the equipment, it is their responsibility to send it as soon as possible by contacting Tahiti Wifi by email for return instructions. The Client is then responsible for paying international return fees.

7.PROPER USE
The equipment rented by Tahiti Wifi remains the property of Tahiti Wifi. Any use of the Tahiti Wifi mobile hotspot contrary to the operational rules described herein or contrary to the regulations in force in French Polynesia is prohibited. It is strictly forbidden for the Client to remove or modify any part of the equipment.

8. PAYMENT SECURITY
Tahiti Wifi uses the Paybox and SystemPay system in partnership with Banque de Tahiti, which employs an SSL (Secure Socket Layer) security system to efficiently encrypt all banking information with software.
No third party has access to confidential payment information. Therefore, the Client’s bank details, when paying for their order online by credit card, will be required for each new order. In any case, following a payment on www.tahitiwifi.com, Tahiti Wifi retains and collects the Clients’ confidential banking data. The credit/debit card number is stored for a period of 30 days from the end of the contract date.

9. REFUND / CANCELLATION

9.1 REFUND / CANCELLATION / MODIFICATION POLICY
The Client can cancel any reservation by contacting Tahiti Wifi via email or phone no later than 24 hours before the rental start date. Beyond this deadline, the Client will be charged penalties equal to 20% of the rental or purchase price.
The Client cannot modify, shorten, or extend their rental directly online on the Tahiti Wifi website.
For any modifications, the Client should contact Tahiti Wifi via email at the following address: [email protected].

9.2 REFUND CONDITIONS
Tahiti Wifi will not be able to refund a rental that has commenced or been completed for the following reasons:

  • Network interruption or issues: As per Article 2.4 of these terms, Tahiti Wifi cannot be held responsible for periods of network unavailability or temporary suspensions occurring due to partner operator-related reasons. While these events are very rare, it is essential to note that extremely adverse weather conditions, for example, could disrupt the proper functioning of the network in French Polynesia and affect the quality of our service.
  • Suboptimal coverage in the islands: Some remote islands like those in the Tuamotu or Australes offer very weak or nonexistent connectivity. Tahiti Wifi is transparent about its network coverage map, which is the responsibility of local partner operators, and clearly communicates with the Client regarding network conditions (at the airport agency, on its website, and in the reservation email). Therefore, no refund could be considered if the Client were to encounter non-functionality due to poor network quality during their stay in the affected islands. The Client rents the equipment with full knowledge and takes the risk that poorly covered islands may impact their equipment’s use. Our agency staff will also advise you if you are traveling to islands with very poor mobile network coverage.
  • Unreported malfunction: Tahiti Wifi undertakes to provide a device in good working condition as part of its obligations to the Client. If a malfunction occurs (beyond any network-related issues, referring to a technical problem with the Tahiti Wifi device), the Client must report the malfunction as soon as possible (if there is no internet connection, it is possible to call the technical team 7 days a week from 5 a.m. to midnight at the number indicated on the back of the device). Tahiti Wifi commits to providing remote technical assistance or, if necessary, replacing the device as quickly as possible. If this delay significantly affects the Client’s rental period, they may be eligible for a goodwill gesture or a partial refund upon request, provided that the Tahiti Wifi team was informed of the malfunction when it occurred and that our team was unable to provide a solution. If the Client informs Tahiti Wifi at the end of their rental, at the time of departure, it is then no longer possible to claim a refund.

For rentals of a device to international destinations (outside French Polynesia), since postal delivery is not possible in case of a verified technical issue that prevents the Client’s device from functioning, the Client may be eligible for a partial refund. Their device will undergo a thorough examination of its connection and use to confirm that Tahiti Wifi is indeed responsible for the equipment malfunction, with the understanding that a network problem is not the responsibility of Tahiti Wifi. In all cases, the Client must have previously informed the Tahiti Wifi team immediately when the malfunction occurred in an attempt to resolve any possible technical issues remotely.
For the purchase of a SIM card, no refund can be considered after activation in case of Client phone incompatibility or exceptional network issues or temporary network interruptions for which the international operator is not responsible.
Refunds will be made exclusively by bank transfer. These refunds may be made to a bank account that is not necessarily in the name of the line or account holder. In the case of fees associated with bank accounts outside of French Polynesia, these fees will be deducted from the refunded amount. Tahiti Wifi does not provide cash or check refunds.

10. DATA CONFIDENTIALITY AND PERSONAL INFORMATION
The Client’s information and personal data collected on various forms available on the Tahiti Wifi website are recorded in a computer file managed by Tahiti Wifi for its commercial and customer management. Tahiti Wifi provides its data management policy in the “privacy policy” section of its website.
In this regard, the Client, by validating their reservation, gives implicit consent to the sending and use of this information, including but not limited to various marketing operations, including telemarketing operations (via their email address). In accordance with the “Data Protection and Freedom of Information” law, you can exercise your right to access data about yourself and have it corrected by contacting: [email protected].
Revocation of consent can be made at any time but must be done in writing to Tahiti Wifi. Tahiti Wifi is registered with the CNIL (National Commission on Informatics and Liberty) under number 2125104, declaration of 27/11/2017. In compliance with the obligations arising from the law of January 6, 1978, regarding computer science, files, and freedoms, under receipt of declaration number 1171130.

11. INTELLECTUAL PROPERTY
Tahiti Wifi is a registered and protected trademark with the National Institute of Intellectual Property (national number: 174395703). All elements of the Tahiti Wifi website are and remain the intellectual and exclusive property of Tahiti Wifi. As such, and in accordance with the provisions of the intellectual property code, no one is authorized to reproduce, exploit, or use any elements of the website www.tahitiwifi.com, even partially, without the formal and express authorization of Tahiti Wifi. Any use of the name Tahiti Wifi or elements from the website, even in part, may lead to legal action and sanctions for violating intellectual property rights.

12. DAMAGE INSURANCE
The Damage Insurance option offered during the reservation covers only equipment damage returned to Tahiti Wifi by the Client or any intentional or unintentional action by the Client or any external event that would render the equipment obsolete.
The insurance comes into effect upon damage declaration at our counter during the rental.
The insurance is void if the Client fails to notify any damage event that occurred during their rental or on any equipment not returned.
If no insurance is taken at the time of reservation on www.tahitiwifi.com, the Client commits to paying the applicable fees as per Article 4.4.
